La cour d’appel de Versailles a confirmé mercredi la condamnation des deux dirigeants du magazine people Closer à une même amende maximale de 45 000 euros, pour avoir publié des photos volées de Kate Middleton la poitrine dénudée. Dans son arrêt, la cour a confirmé en tout point le jugement rendu en première instance, qui avait condamné la directrice de rédaction Laurence Pieau et le directeur de publication Ernesto Mauri pour complicité ou divulgation d’un document obtenu par une atteinte à l’intimité de la vie privée. La cour a aussi suivi le tribunal correctionnel de Nanterre en validant les 100 000 euros de dommages et intérêts alloués à Kate Middleton et à son mari le prince William. Courroux de la famille royale britannique Le litige remonte au 14 septembre 2012, date de diffusion dans les kiosques français du N°379 de l’hebdomadaire people. Il contenait des clichés estivaux de la duchesse et du duc de Cambridge - deuxième dans l’ordre de succession au trône britannique - au bord de la piscine d’un luxueux domaine du Sud de la France. Sur ces photos, Kate Middleton ne portait qu’un bas de maillot de bain. Cette publication avait fait scandale Outre-Manche et provoqué le courroux de la famille royale britannique. Les services du prince avaient alors dénoncé une atteinte « grotesque et injustifiable » à la vie privée et, en urgence, le couple princier avait obtenu de la justice française l’interdiction de toute nouvelle diffusion des images, que même les tabloïds anglais s’étaient refusés à publier. Deux photographes, soupçonnés d’être les auteurs des clichés, ont aussi vu leur condamnation confirmée mercredi à 10 000 euros dont 5 000 avec sursis. Ces deux paparazzi de l’agence parisienne Bestimage, Cyril Moreau et Dominique Jacovides, ont toujours nié avoir pris les photos incriminées.

The French version of the magazine Closer has been banned from publishing online or in print, any more of those topless pictures of the Duchess of Cambridge. Lawyers representing her and her husband, Prince William, were successful in arguing a civil case, they sought around £4,000 in damages and asked for the original images to be handed over to them. Difficulty is of course the magazine doesn't own the original photos. The man who took them is believed to be in hiding. Catherine Middleton was photographed sunbathing on a balcony while on holiday with the Duke. The shots were taken with a telephoto lens from the road, a kilometre away from the terrace of the chateau where they were staying. Crowds flocked to see the young royals leaving the Solomon Islands to Tuvalu, on what will be their last day of a South East Asian Queen's Diamond Jubilee tour. The couple have been doing their best to ignore the intense media scrutiny since the photos were released. Those representing French Closer magazine in court defended the publication, saying photos like this don't shock people anymore. If the magazine owners decide to ignore the injunction, they will be fined around £8,000 for every day they refuse to surrender all their copies of the images of Catherine. They also have to pay the royal couple around £1,600 in legal fees. Although French Closer won't be allowed to republish the images, it stills leave the matter of the 50 page special in its Italian sister magazine, Chi, and the fact that the pictures are now widely available for free online. A criminal inquiry has also been started today to find out whether, under French law, the Royal couple's right to privacy has been breached.

According to a report in Reuters, Closer's editor-in-chief Laurence Pieau defended the "beautiful series" of photos. "There's been an over-reaction to these photos. What we see is a young couple, who just got married, who are very much in love, who are splendid," Pieau told French BFM television, adding that the magazine had more 'intimate' shots from the same series that it chose not to publish.

Lawyers representing the Duke and Duchess of Cambridge are expected to appear in a court in Paris today to face the editor of Closer, the French magazine, which published topless photos of Catherine. They'll be arguing a criminal case for the breach of the Royals' privacy and they will be seeking a ban on the sale of the magazine, which has sparked worldwide controversy, ever since the Italian version of Closer first bought the pictures and the French one followed suit. Laurence Pieau, Editor-in-Chief, argued that the lack of security - which allowed the photos to be taken in the first place - is the bigger issue, rather than an invasion of privacy. As for legal action against the publication, she said: 'We'll see what happens', adding that she didn't publish the most degrading pictures, only those which showed 'a wonderful couple in love'. "We decided to publish these pictures in the French Closer because we thought these pictures are not shocking. For us, these pictures are the picture of a wonderful couple which is in love and nothing else." News of the photos dominated the British weekend headlines with many people astonished that any publication would want to profit from such tasteless photos. The editors' actions have echoes of the constant and over the top media intrusion that Prince William's mother, Diana, faced. The Duke and Duchess of Cambridge have already said they are 'very angered' in that regard. Meanwhile there's more fallout on this side of the Channel regarding the controversial pictures. The co-owner of The Irish Daily Star, Richard Desmond (who also owns The Express and the Daily Star newspapers in England), is said to be 'furious' and will cut ties with the title and is taking steps to have it shut down. The Duke and Duchess meanwhile are still enjoying their 9-day long public Diamond Jubilee engagement in South East Asia, which is coming to an end. They gave away nothing of their feelings of anger or frustration over the current situation. The celebrity gossip magazine printed pictures of the duchess taken during the couple's private holiday in France. A royal spokesman said the legal proceedings had been launched in France and were for breach of privacy. Closer's editor says the couple were "visible from the street". "These photos are not in the least shocking. They show a young woman sunbathing topless, like the millions of women you see on beaches," said Laurence Pieau. She described the reaction as "a little disproportionate". The magazine's website says the pictures are of the couple "like you have never seen them before. Gone are the fixed smiles and the demure dresses. On holiday Kate forgets everything." French publication Closer printed the pictures of the duchess A royal spokesman said: "St James's Palace confirms that legal proceedings for breach of privacy have been commenced today in France by the Duke and Duchess of Cambridge against the publishers of Closer Magazine France." The BBC's Nicholas Witchell said he had rarely seen such a level of publicly expressed anger over such an incident, and this anger reflected William's feelings on the matter. Our correspondent said that the prince had a "look of absolute thunder" on his face as they left Kuala Lumpur - a stop on their nine-day tour of South East Asia - to travel to Sabah in north Borneo. Kate, meanwhile, "looked composed and was smiling", he said. The duke and duchess, who were staying at the French chateau of the Queen's nephew, Lord Linley, "have been hugely saddened to learn that a French publication and a photographer have invaded their privacy in such a grotesque and totally unjustifiable manner", a spokesman for Clarence House, the Prince of Wales's office, said earlier. British newspapers were offered photographs last week but turned them down. The Sun - the only British publication to publish recent pictures of Prince Harry naked - said it had no intention of publishing the images. "The circumstances are very different to those relating to the photos of Prince Harry in Las Vegas. As we said at the time, he was at a party in a hotel suite with a large group of strangers and one of those present released a photograph into the public domain," said the Sun's editor Dominic Mohan.

A JUDGEMENT is due today on whether France’s Closer magazine should pay up to £1.4million in damages to the Duke and Duchess of Cambridge for violating their privacy. It was almost five years ago that six people went on trial at a court in Nanterre, west Paris, over the long-lens images of Kate sunbathing on a terrace in September 2012. The photos were taken as Kate holidayed with Prince William at a private chateau in Provence, southern France, and were published on the front and inside pages of France's Closer magazine with the headline “Oh my God!”. The judgment comes a day after it was announced that Kate and William are expecting a third child. Presiding judge Florence Lasserre-Jeannin is expected to deliver her verdict at the Tribunal de Grande Instance de Nanterre. The six defendants deny the charges. They are linked to Closer Magazine and the regional newspaper La Provence which published photographs of Kate in her swimwear. Ernesto Mauri, 70, chief executive of publishing group Mondadori which produces Closer, faces one charge of using a document obtained by a breach of privacy, as does Marc Auburtin, 57, who was La Provence's publishing director at the time. Laurence Pieau, 51, editor of Closer magazine in France, is charged with complicity. Agency photographers Cyril Moreau, 32, and Dominique Jacovides, 59, and La Provence photographer Valerie Suau, 53, are accused of invading privacy and complicity. Paul-Albert Iweins, representing Closer, argued the photos did not constitute a breach of privacy and cast the young couple in a positive light. The Royal couple’s French barrister Jean Veil told the court William and Kate suffered hugely from the pictures. He said they deserved the damages and compensation to add to “significant fines” against the accused. In a statement read to the court, William, 34, branded the decision to publish topless photographs of his wife “particularly shocking”, given his late mother’s battles with paparazzi. One image showing William rubbing sun cream into his wife’s skin is said to have been particularly upsetting for the couple. The verdict is due 1:30pm French time which is 12:30pm in the UK.

Lawyers for the Duke and Duchess of Cambridge will lodge a criminal complaint with the French prosecutor on Monday over topless pictures taken of the Duchess. The court also ordered the defendants to pay damages to Kate and her husband Prince William, but the amount was significantly lower than that sought by the royal family. Kensington Palace said Tuesday that the Duke and Duchess of Cambridge are pleased with the ruling and consider the matter now closed. The court in a Paris suburb ruled that three photographers and three newspaper executives invaded the privacy of the duchess by taking and publishing the photos. Two executives of French gossip magazine Closer were each given the maximum 45,000 euros (53,500 US dollars) fine for such an offense. In addition, the two executives, along with two photographers working with a celebrity photo agency, were collectively ordered to pay 50,000 euros (59,500 US dollars) in damages to Kate and the same amount to William. The amount is far below the about 1.5 million euros in damages sought by the royal couple. Lawyer Christopher Mesnooh said the court awarded the damages in line with the French legal system. The couple, who didn't attend the verdict, had filed a complaint after the photos were published in Closer and a regional newspaper in 2012, the year after their wedding. The pictures of Kate were taken with telephoto lenses while she and her husband apparently were sunbathing on a patio at a private estate in France's southern Provence region. The royal couple arrived in the Solomon Islands on Sunday; part of a tour of Singapore, Malaysia and the South Pacific. But their travels have been overshadowed by the publication of paparazzi snaps in the French magazine Closer of Kate sunbathing topless during a holiday at a private villa in the south of France. A spokeswoman for William's St. James's Palace office said the couple's lawyers would file a complaint with French prosecutors on Monday against the unidentified photographer or photographers involved. The palace said it would be up to French prosecutors to decide whether to investigate and pursue a criminal case for breach of privacy or trespassing. On Monday Italian gossip magazine, Chi, published a 26-page spread of the photos. Many were the same as those first published by Closer. Both Closer and Chi are owned by former Italian Premier Silvio Berlusconi's Mondadori publishing house. Lawyers for the royal couple are due in a civil court in Paris later on Monday to seek an injunction against Mondadori to prevent further dissemination of the images, which were also reproduced over the weekend by an Irish tabloid. Closer's editor says the couple were "visible from the street" and the images are "not in the least shocking". The BBC's Nicholas Witchell said that the royals were "incredulous that any magazine would have felt they had a justification in publishing these pictures". "They could go to law or seek a remedy through the French court - that is a big step to take but that is clearly what is being considered now," he said.
